Terms of Service

These terms govern your use of beautyandfly.com and the booking tools on it. By using the site or booking an appointment you agree to them. The site is operated by Beauty and Fly, 77 Pondfield Road, Suite GF3, Bronxville, NY 10708, and by Catherine Curtin, MSN, FNP-C.

What This Site Can and Cannot Tell You

Everything on this site is general information about the treatments offered. It is not medical advice, and reading it does not make you a patient. Whether a treatment suits you is decided at a consultation, after Catherine has taken your history and looked at your face. If you have an urgent medical concern, call 911 or your physician.

Who May Use the Site

You must be 18 or older to book an appointment or purchase anything through this site. A minor may be treated only with a parent or guardian present and their written consent.

Appointments, Deposits and No-Shows

Consultations are complimentary and require no deposit. A card holds the time. If you need to cancel or move an appointment, please give at least 48 hours' notice; late cancellations and missed appointments are handled under the no-show policy, which forms part of these terms. Booking through the site is a request until you receive a confirmation.

Pricing and Payment

Prices shown on the site are current at the date at the top of this page and can change. Your final cost is confirmed with you at your consultation. Payment is due at the time of treatment. Monthly billing for the Beauty Bank is at the rate on the Beauty Bank page, and member pricing applies only while the membership is active.

Gift Cards

Gift cards are redeemable for services and products at Beauty and Fly and are not redeemable for cash except where the law requires. They cannot be replaced if lost or stolen.

Results

Every face responds differently. Photographs, timelines and descriptions on this site show what treatment has done for other patients and what it commonly does; they are not a guarantee of what your own skin will do. At your consultation, Catherine says what she expects for you and what she would leave alone.

Communications

By giving Catherine your phone number or email address you agree that she may contact you about your inquiry and appointments. Marketing messages are sent only if you opt in, and you can stop them at any time by replying STOP to a text or using the unsubscribe link in an email. Your Conduct

You agree not to misuse the site: no scraping, no attempts to access other people's information, no uploading of anything unlawful, and no use of the booking tools to hold appointments you do not intend to keep.

Intellectual Property

The text, photographs, graphics and design of this site belong to Beauty and Fly or are used under license. You may view and print pages for your own use. Reproducing or republishing any part of the site without written permission from Beauty and Fly is not allowed. Botox, Dysport, Daxxify, Sculptra, Restylane, RHA, Kybella and other product names are trademarks of their owners.

Third-Party Links

The site links to other websites, including product manufacturers, review platforms and booking and payment providers. Those sites are outside the control of Beauty and Fly, and it is not responsible for their content or their handling of your information.

Disclaimers and Limitation of Liability

The site is provided as is. No warranty is made that it will be uninterrupted or error-free. To the fullest extent the law allows, Beauty and Fly is not liable for any indirect, incidental or consequential loss arising from your use of the site. Nothing in these terms limits liability that cannot be limited by law, and nothing in them affects the standard of care you receive as a patient.

Indemnification

You agree to indemnify Beauty and Fly against claims arising from your misuse of the site or your breach of these terms.

Governing Law

These terms are governed by the laws of the State of New York. Any dispute about the site or these terms will be brought in the state or federal courts located in Westchester County, New York. If any part of these terms is found unenforceable, the rest continues to apply.

Changes to These Terms

These terms may be updated from time to time. Changes are posted here with a new date at the top of the page, and your continued use of the site after that date means you accept them.
